By its action under Article 263 TFEU, the applicant seeks the annulment of the decision of the First Board of Appeal of the European Union Intellectual Property Office (EUIPO) of 27 June 2023 (case R 2172/2022-1).

The Court:

1.Annuls the decision of the First Board of Appeal of the European Union Intellectual Property Office (EUIPO) of 27 June 2023 (case R 2172/2022-1);

2.Orders EUIPO to pay, in addition to its own costs, those incurred by AC Marca Brands, SL for the purposes of the proceedings before the Court;

3.Dismisses the action as to the remainder.
