Pleas in law and main arguments

In support of the action against the decision bearing the reference SGS 24/00015 of the Council of the European Union of 13 May 2024 refusing in part to grant access to documents ST 6513/23 and ST 6515/23, the applicants rely on two pleas in law.

First plea in law, alleging infringement of the third indent of Article 4(1)(a) of Regulation (EC) No 1049/2001 of the European Parliament and of the Council of 30 May 2001 regarding public access to European Parliament, Council and Commission documents. That plea in law is divided into three parts.

The first part, concerning the alleged risk that the persons covered by the restrictive measures could more easily ‘evade’ that set of restrictive measures.

The second part, concerning the alleged risk of ‘misunderstandings’ or ‘misinterpretations’.

The third part, concerning the inapplicability of the exception set out in the third indent of Article 4(1)(a) of Regulation No 1049/2001 to the situation in the present case.
