declare that, by failing to adopt the provisions necessary to transpose Directive 2006/43/EC of the European Parliament and of the Council of 17 May 2006 on statutory audits of annual accounts and consolidated accounts, amending Council Directives 78/660/EEC and 83/349/EEC and repealing Council Directive 84/253/EEC, (1) and by failing to inform the Commission thereof, the Republic of Estonia has failed to fulfil its obligations under the directive;

order the Republic of Estonia to pay the costs.

Pleas in law and main arguments

The time-limit for transposition of the directive into national law expired on 29 June 2008.
