(Case T-374/25)

(C/2025/4468)

Language of the case: English

Parties

Applicant: EO (represented by: L. Levi and P. Baudoux, lawyers)

Defendant: European Parliament

Form of order sought

The applicant claims that the Court should:

annul the defendant’s decision of 12 July 2024 rejecting the applicant’s claim for compensation of 14 March 2024;

if need be, annul the defendant’s decision of 6 March 2025 rejecting the complaint of the applicant dated 10 October 2024;

order the defendant to compensate the applicant for all the damage suffered; and,

order the defendant to pay all the costs.

Pleas in law and main arguments

This action for damages is brought against the defendant on account of an unlawful conduct committed in the applicant’s case:

The defendant published a press release in which it alleged that the applicant had been involved in a scandal and that it supported the applicant’s suspension. The applicant’s name was not explicitly mentioned, but it was obvious that the defendant was referring to the applicant, given that when it published this press release, it decided to delete the applicant’s profile on the official website of the political group to which he belonged. Besides, sources inside the Institution confirmed to journalists that this was the applicant referred to in the press release. These wrongful actions occurred simultaneously - making it obvious for the public/journalists to identify the applicant as the alleged offender. Following these wrongful actions, journalists wrote press articles about the applicant’s alleged involvement in the scandal and people made several negative comments about the applicant on social media.
