The appellant submits that the judgment of the General Court declaring its action inadmissible on the ground that it is not directly and individually concerned by Commission decision C (2015) 3228 final of 11 May 2015 should be set aside on the ground that it violates the principle of effective judicial protection.
Pleas in law and main arguments
The appellant argues that indirect access to the Court of Justice via a reference for a preliminary ruling from the Polish courts does not provide the protection envisaged by article 6(1) of the European Convention on Human Rights.
