$The time-limit for bringing proceedings provided for in the fifth paragraph of Article 173 of the Treaty (now, after amendment, Article 230, fifth paragraph, EC) is designed to ensure not only that the applicant has a reasonable amount of time in which to assess whether there exist grounds for contesting a measure and, if so, to prepare his application, but also that a measure cannot be the subject of an application for annulment after a certain time has elapsed. Only by means of the strict application of the time-limit thus prescribed is it possible to fulfil the requirements of legal certainty and the need to avoid any discrimination or arbitrary treatment in the administration of justice.
