The appellant claims that the Court of Justice should:

Set aside the judgment of the General Court of 8 May 2024 in Case T-234/22, Ismailova v Council, EU:T:2024:287;

Annul (i) Council Decision (CFSP) 2022/582 of 8 April 2022 amending Decision 2014/145/CFSP concerning restrictive measures in respect of actions undermining or threatening the territorial integrity, sovereignty and independence of Ukraine; (ii) Council Implementing Regulation (EU) 2022/581 of 8 April 2022 implementing Regulation (EU) No 269/2014 concerning restrictive measures in respect of actions undermining or threatening the territorial integrity, sovereignty and independence of Ukraine; (iii) Council Decision (CFSP) 2023/572 of 13 March 2023 amending Decision 2014/145/CFSP concerning restrictive measures in respect of actions undermining or threatening the territorial integrity, sovereignty and independence of Ukraine; (iv) Council Implementing Regulation (EU) 2023/571 of 13 March 2023 implementing Regulation (EU) No 269/2014 concerning restrictive measures in respect of actions undermining or threatening the territorial integrity, sovereignty and independence of Ukraine;

In the alternative, set aside the judgment referred to above and remit the case to the General Court;

Order the Council to pay all of the appellant’s costs, both as concerns the proceedings at first instance and the present appeal proceedings.

Grounds of appeal and main arguments

The appellant puts forward four grounds in support of the appeal.

First ground of appeal: the General Court infringed the scope of its legal review while making several errors in law – related infringement of essential procedural requirements – infringement of Article 13 TEU and Article 47 of the Charter of Fundamental Rights.

Second ground of appeal: error in law by infringement and misinterpretation of the criterion of association – in the alternative, plea of illegality and inapplicability in respect of criterion (a) pursuant to Article 277 TFEU.

Third ground of appeal: error in law by distortion of the evidence and the facts – infringement of essential procedural requirements and of the requirement to provide reasoning on the basis of Article 263 TFEU in conjunction with Article 296 TFEU;

Fourth ground of appeal: infringement of the criterion of association and the principle of legal security.
