declare the present action admissible and well-founded;

annul the contested decision, and where necessary, the implied decision to reject the complaint previously lodged against the contested decision;

order the defendant to pay all the costs.

Pleas in law and main arguments

In support of the action seeking the annulment of the salary slip for May 2024 in so far as it does not include a social assistance payment provided for by Commission’s Decision C(2015) 4907 final of 22 July 2015 on a payment of social assistance to some Commission staff members employed in Luxembourg, the applicant relies on four pleas in law:

1.First plea in law, alleging infringement of Decision C(2015) 4907 final of 22 July 2015 and a manifest error of assessment;

2.Second plea in law, based on a breach of the principle of equal treatment;

3.Third plea in law, based on a breach of the fundamental right to dignity in working conditions.

4.Fourth plea in law, based on a breach of the principle of the protection of legitimate expectations.
