Re:

By his action based on Article 263 TFEU, the applicant seeks the annulment of Commission Implementing Regulation (EU) 2023/2660 of 28 November 2023 renewing the approval of the active substance glyphosate in accordance with Regulation (EC) No 1107/2009 of the European Parliament and of the Council and amending Commission Implementing Regulation (EU) No 540/2011 (OJ L 2023/2660).

Operative part of the order

1.The action is dismissed as inadmissible.

2.There is no longer any need to adjudicate on the application to intervene submitted by Bayer Agriculture BV.

3.Mr Dominique Masset is to bear his own costs and shall pay those incurred by the European Commission, with the exception of those relating to the application to intervene.

4.Mr Masset, the Commission and Bayer Agriculture are each to bear their own costs relating to the application to intervene.
