The applicant claims that the Court should:

declare that, since it has failed to establish a plan as part of maritime spatial planning by 31 March 2021 and has failed to send a copy of such a plan to the Commission and the other Member States concerned within three months of its publication, the Italian Republic has failed to meet its obligations under Articles 8(1), 15(3) and 14(1) of Directive 2014/89/EU;

order Italian Republic to pay the costs.

Pleas in law and main arguments

In its action, the Commission claims that, under Articles 8(1) and 15(3) of Directive 2014/89/EU, which establishes a framework for maritime spatial planning, Member States are obliged to establish the relevant national maritime spatial plans by 31 March 2021. Under Article 14(1) of that directive, Member States are obliged to send copies of the national maritime spatial plans to the Commission within three months of their publication.

In its action, the Commission states that, in its replies to the reasoned opinion, the Italian Republic does not contest the claim that it has not adopted a maritime spatial plan by 31 March 2021 and that it has not sent a copy of that plan to the Commission and the other Member States concerned within three months of its publication.
