declare that, by failing to adopt the laws, regulations and administrative provisions necessary to ensure application of Council Directive 2004/82/EC of 29 April 2004 on the obligation of carriers to communicate passenger data, (1) or, in any event, by not informing the Commission of those provisions, the Republic of Poland has failed to fulfil its obligations under Article 7 of that directive;

order the Republic of Poland to pay the costs of the proceedings.

The period within which Directive 2004/82 had to be transposed expired on 5 September 2006.
