The applicant claims that the Court should:
—annul the Commission’s decision to adopt the Final Audit Report, Audit Reference Number 14-BA262-013, as final, as notified to the United Kingdom Government by letter dated 20 December 2018 and received on 21 January 2019;
—order the Commission to pay the costs.
In support of the action, the applicant relies on two pleas in law.
1.First plea in law, alleging that the Auditors erred in law in finding that daily timesheets were required and, in doing so, misinterpreted the Grant Agreements.
2.Second plea in law, alleging that the Final Audit Report unlawfully frustrates the Met Office’s legitimate expectation that its ex post facto time recording system and its monthly calculation of indirect costs rates would satisfy the requirements of the Grant Agreements.
