The Republic of Austria has infringed its obligations under Article 2 of Directive 2005/33/EC of the European Parliament and of the Council of 6 July 2005 amending Directive 1999/32/EC as regards the sulphur content of marine fuels (1) by failing to adopt the regulations and administrative provisions necessary to implement the Directive or by failing to inform the Commission of their adoption.

Order the Republic of Austria to pay the costs.

Pleas in law and main arguments

The time-limit for implementation of the Directive expired on 11 August 2006.
