Application for annulment of the decision not to promote the applicant to Grade AST 3 in the 2013 promotion exercise and seeking damages for the non-material loss allegedly suffered.
Operative part of the judgment
The Tribunal:
1.Annuls the decision of the appointing authority of the European External Action Services of 9 October 2013 fixing the list of officials promoted in the 2013 promotion exercise in so far as the name of Mr Riberio Sinde Monteiro is not included on that list.
2.There is no need to rule on the application as to the remainder.
3.Orders the European External Action Service to bear its own costs and to pay the costs incurred by Mr Ribeiro Sinde Monteiro.
