The applicant claims the following:

The Court should declare that the Commission, as the defendant, infringed EU law by failing to process the confirmatory application submitted by the applicant Compass-Datenbank GmbH on 17 August 2023 for the reuse of the documents of the ‘European Central Platform’.

The Court should also declare that the Commission, as the defendant, must pay the applicant, Compass-Datenbank GmbH, its procedural costs.

Pleas in law and main arguments

The applicant alleges infringement by the defendant of the time limit laid down in Article 8 of Regulation (EC) No 1049/2001 for the processing of confirmatory applications and brings an action pursuant to paragraph 3 of that provision.

As an Austrian provider of business information, the applicant had submitted an application for the reuse of the contents of the ‘European Central Platform’ (ECP) in accordance with Decision 2011/833/EU (1) and Regulation (EC) No 1049/2001. (2)

After the defendant stated that it did not have any documents that corresponded to the request, the applicant submitted a detailed and reasoned confirmatory application for the reuse of the documents in question. The defendant did not respond to that request within the specified time limits.
