By her action under Article 270 TFEU, the applicant, LW, seeks the annulment of her appraisal report of 20 July 2021 for the 2020 period; the annulment, in so far as is necessary, of the decision of the appeal assessor of 13 July 2022 that confirmed the contested appraisal report and of the decision of the appointing authority of 24 January 2023 that rejected the applicant’s complaint, as well as compensation for the non-material damage which the applicant claims to have suffered.

Operative part of the judgment

The Court:

1.Dismisses the action;

2.Orders LW, in addition to bearing her own costs, to pay the costs incurred by the European Commission.
