The applicant claims that the Court should:

uphold the action in its entirety;

annul Decision D 500276 of the Director-General for Finance of the European Parliament of 21 February 2025 relating to the recovery of the amount of EUR 162 648,34 and the relating order for payment concerning the corresponding amounts allegedly unduly paid as parliamentary assistance allowance;

order the European Parliament to pay the costs of the proceedings and his lawyer’s fees.

Pleas in law and main arguments

In support of the action, the applicant relies on four pleas in law.

1.First plea in law, alleging failure to observe the reasonable time limit regarding action by the administrative authority and the adoption of decisions against the person under investigation, in so far that it is an integral part and a condition of sound administration in accordance with Article 41(1) of the Charter of Fundamental Rights of the European Union.

2.Second plea in law, alleging breach of the applicant’s fundamental right to be heard in advance and to access his file in accordance with Article 41(1) of the Charter of Fundamental Rights of the European Union.

3.Third plea in law, alleging incorrect interpretation and application of the legal framework in force, Articles 36 and 74 of the Financial Regulation in particular, and of relevant judicial decisions.

4.Fourth plea in law, alleging contradictory and misleading hypotheses on the part of the administrative authority and incorrect interpretation and application of the applicable legal framework.
