The Court:

1)declares that, since the Hellenic Republic failed to submit a report on cost-optimal levels, as is laid down in Article 5(2) of Directive 2010/31/ΕU (1) of the European Parliament and of the Council of 19 May 2010 on the energy performance of buildings, as supplemented by Commission Delegated Regulation (EU) No 244/2012 (2) of 16 January 2012 establishing a comparative methodology framework for calculating cost-optimal levels of minimum energy performance requirements for buildings and building elements, the Hellenic Republic has failed to fulfil its obligations under Article 5(2) of Directive 2010/31.

2.orders the Hellenic Republic to pay the costs.
