The Court:
1.Dismisses the appeals;
2.Orders Mr Christian Kurrer, Mr Salvatore Magazzu and Mr Stefano Sotgia to bear their own costs and to pay those incurred by the European Commission in the present proceedings;
3.Orders the Council of the European Union to bear its own costs.
