Operative part of the judgment

The Court:

1.Declares that, by failing to take the measures necessary to ensure, so far as concerns the Ljubljana agglomeration:

that urban waste water entering collecting systems is subject, before discharge, to secondary treatment or an equivalent treatment, and

the appropriate monitoring of discharges from urban waste water treatment plants,

the Republic of Slovenia has failed to fulfil its obligations under Article 4(1) and (3) of Council Directive 91/271/EEC of 21 May 1991 concerning urban waste water treatment, as amended by Regulation (EC) No 1137/2008 of the European Parliament and of the Council of 22 October 2008, read in conjunction with section B of Annex I to that directive, as amended, and the first indent of Article 15(1) of that directive, as amended, read in conjunction with section D of Annex I thereto, respectively;

2.Dismisses the action as to the remainder;

3.Orders the European Commission and the Republic of Slovenia to bear their own costs.
