In view of the foregoing, it is necessary to clarify whether, in the light of the provisions of Article 16(1) of Council Regulation (EC) No 1/2003, the evidence of Euribor manipulations, as established in the Commission decisions cited above and in the judgment of the Court of Justice in Case C-883/19, HSBC Holdings and Others v Commission, must be regarded as having been definitively obtained also by the national courts and whether the restriction of competition which is the subject of the decisions of the Commission and the Court of Justice constitutes an agreement prohibited by Article 101 [TFEU] solely in the derivatives market or in any market which used the manipulated Euribor benchmark.
