The applicant claims that the Court should:

annul the applicant’s staff report for the year 2022 and the decision to award her only one merit point for the 2022 appraisal exercise;

annul, together with the above, so far as necessary, the decision of 7 October 2024 rejecting the complaint lodged by the applicant under Article 90(2) of the Staff Regulations of the European Union against her staff report and the decision to award one merit point;

order reimbursement by the defendant of all the costs.

Pleas in law and main arguments

In support of the action, the applicant relies on three pleas in law.

1.First plea in law, alleging breach of Article 43 of the Staff Regulations and of Articles 5(8) and 6(2) of the Internal Rules governing the application of the General Implementing Provisions.

2.Second plea in law, alleging manifest errors of assessment and breach of impartiality.

3.Third plea in law, alleging breach of the duty of care and breach of the protection of personal data.
