The applicant claims that the Court should:

annul Council Decision (EU) 2023/1335 of 27 June 2023 appointing the European Prosecutors of the European Public Prosecutor’s Office,

reprimand the European Commission for its failure, which culminated on 21 June 2023, to carry out a review, which it was required to do, of the legality of the proposal made by Greece in that connection,

declare that that failure to act is in breach of EU law, and

order the defendant to pay the costs.

Pleas in law and main arguments

In support of the action, the applicant relies on the following pleas in law.

1.Regarding the Council decision: breach of EU law and, more specifically, Article 16(1) of Regulation (EU) 2017/1939, with the result that reasoning of the contested Council decision is unlawful.

2.Regarding the Commission’s failure to act: complete absence of reasoning, which constitutes an infringement of essential procedural requirements, and breach of the principle of sound administration.
