Annul the decision of the Selection Board of 25 July 2024 excluding the applicant from the COM/AST3/2024 internal competition;

Order the defendant to pay the applicant EUR 5 000 by way of compensation for damage caused by the defendant’s error;

Order the defendant to pay the costs.

Pleas in law and main arguments

In support of the action, the applicant relies on one single plea in law alleging the arbitrary nature of the decision to exclude her from the competition, based on the unsubstantiated claim according to which she had breached the competition rules. The applicant considers that the decision is neither explained nor reasoned and does not allow her to understand the origin of that serious accusation which was the reason for her exclusion from the competition and regarding which she could not defend herself other than by confirming that she did not use a second screen during the tests.
