—declare the present action admissible and well-founded;
consequently,
—annul the decision of 28 December 2023 in so far as it rejects the applicant’s claim for compensation dated 17 July 2023;
—to the extent necessary, annul the decision of 23 July 2024 in so far as it rejects the applicant’s internal appeal dated 28 February 2024;
—order the defendant to compensate the applicant for the non-material and financial damage caused;
—order the defendant to pay all of the costs.
Pleas in law and main arguments
In support of the action, the applicant relies on two pleas in law.
1.First plea in law, alleging that the dispensation measure has no legal basis and that the investigation was conducted outside the proper procedural framework.
