The applicant claims that the Court should:

annul, in whole or in part, Article 2 of Commission Decision No. C(2024) 8150 final, relating to a proceeding under Article 101 of the Treaty on the Functioning of the European Union and Article 53 of the EEA Agreement (Case AT.40642 – Pierre Cardin), adopted by the defendant on 28 November 2024 (‘Contested Decision’);

in the alternative, reduce the fine imposed on the applicant;

annul, in whole or in part, Article 3 of the Contested Decision;

order the Commission to pay the costs of the present proceedings, including those related to any intervener.

Pleas in law and main arguments

In support of the action, the applicant relies on a single plea in law, alleging that the Commission committed errors of law and assessment when applying the 10 % turnover ceiling provided for in Article 23(2) of Council Regulation (EC) No. 1/2003 of 16 December 2002 on the implementation of the rules on competition laid down in Articles 81 and 82 of the Treaty (OJ L 1, 4.1.2003, p. 1).
