The applicants claim that the Court should:
—annul, in whole or in part, the decision by ECHA of 3 April 2025 with reference ATD/027/2025, ATD/029/2025 by which ECHA granted partial access to a document containing information from five export notifications submitted by DLF Beet Seed ApS with regard to the substances ‘Beta-cyfluthrin’, ‘Clothianidin’, ‘Thiamethoxam’, and ‘Thiram’;
—order ECHA to pay the costs of the proceedings.
In support of the action, the applicants rely on two pleas in law.
1.First plea in law, alleging that the defendant erred in the interpretation and application of Article 6(1) and 6(2) of Regulation (EC) No 1367/2006 of the European Parliament and of the Council (1).
2.Second plea in law, alleging that the defendant erred in the interpretation and application of Article 4(2) of Regulation (EC) No 1049/2001 of the European Parliament and of the Council (2) in conjunction with Article 6(1) and 6(2) of Regulation No 1367/2006.
