The appeal is based on two grounds.

First, the General Court carried out an erroneous legal analysis of the facts underlying the application, which results from the Court ignoring the contents of the complaint lodged by the appellant despite the fact that it had understood these contents perfectly well.

Second, the General Court applied a likewise erroneous standard of proof.
