By its action under Article 263 TFEU, the applicant seeks the annulment of the decision of the European Food Safety Authority (EFSA) of 17 February 2023 notifying it of its decision to disclose fully, on 3 March 2023, the list of co-formulants present in the formulation for representative uses of the plant protection product Captan 80 WG submitted in the framework of the renewal of the approval of the active substance captan.
The Court:
Dismisses the action;
Orders Arysta Lifescience to bear its own costs and to pay those incurred by the European Food Safety Authority (EFSA) and by Mr Claude Gruffat and Mr Benoît Biteau, including EFSA’s costs relating to the proceedings for interim relief.
